IP 1. Purpose and scope
This Policy sets out how JN Short handles COPYRIGHT and TRADE MARK complaints for content made available through the Service (including short links, QR codes, bio pages and hosted files, where enabled). It complements our MODERATION, NOTICE‑AND‑ACTION & APPEALS POLICY (DSA) and the ACCEPTABLE USE POLICY (AUP). CAPITALISED TERMS have the meaning in the Terms of Service (the “Terms”).
IP 2. How to report copyright infringement (notice)
2.1 PREFERRED CHANNEL. Submit a COPYRIGHT NOTICE at https://jnshort.com/contact or e‑mail ip@jnshort.com. Notices sent elsewhere may take longer to process.
2.2 REQUIRED ELEMENTS. TO BE ACTIONABLE, YOUR NOTICE SHOULD INCLUDE:
(a) IDENTIFICATION OF THE COPYRIGHTED WORK claimed to be infringed (attach links or copies; include registration numbers if available).
(b) IDENTIFICATION OF THE ALLEGEDLY INFRINGING MATERIAL with sufficient information for us to locate it: the SHORT LINK/QR CODE, any DESTINATION URL(S), BIO PAGE or HOSTED FILE URL(s), and relevant timestamps.
(c) AUTHORITY. A statement that YOU ARE THE RIGHTS HOLDER OR AUTHORISED TO ACT on the rights holder’s behalf, including any chain of title or licence where relevant.
(d) GOOD‑FAITH STATEMENT. “I have a GOOD‑FAITH BELIEF that the use of the material in the manner complained of is NOT AUTHORISED by the rights holder, its agent, or the law.”
(e) ACCURACY STATEMENT. “The information in this notice is ACCURATE to the best of my knowledge.”
(f) CONTACT DETAILS for follow‑up and service of communications: full name, organisation (if any), postal address, country, e‑mail address, and phone number.
(g) SIGNATURE. A physical or ELECTRONIC SIGNATURE (typed name is acceptable).
(h) JURISDICTION & TERRITORY (optional): the country/region(s) where you claim the work is protected and where infringement occurs.
(i) EVIDENCE (where available): screenshots, copies, hashes, or other documentation supporting your claim.
2.3 INCOMPLETE NOTICES. If a notice is incomplete or unclear, WE MAY REQUEST ADDITIONAL INFORMATION or decline action until we can verify the claim. ABUSIVE OR MANIFESTLY UNFOUNDED NOTICES MAY LEAD TO RESTRICTIONS ON YOUR ABILITY TO REPORT.
IP 3. What happens after you report (triage & action)
3.1 ACKNOWLEDGEMENT. We acknowledge receipt and assign a CASE ID.
3.2 TRIAGE. We assess completeness, jurisdiction, and risk (e.g., live redistribution). Where appropriate, we may PRESERVE LOGS AND CONTENT SNAPSHOTS.
3.3 INTERIM MEASURES. For clear cases, we may DISABLE the short link/QR/bio/file or apply GEO‑BLOCKING (where proportionate) while we notify the RECIPIENT OF THE SERVICE and offer a COUNTER‑NOTICE path.
3.4 STATEMENT OF REASONS. If we restrict content or an account, WE WILL ISSUE A STATEMENT OF REASONS in line with the DSA, including HOW TO APPEAL.
IP 4. Counter‑notice (response from the recipient of the service)
4.1 WHO MAY SUBMIT. The account holder responsible for the affected content may submit a COUNTER‑NOTICE at https://jnshort.com/contact (select “Counter‑Notice”) or e‑mail ip@jnshort.com quoting the CASE ID.
4.2 REQUIRED ELEMENTS. A VALID COUNTER‑NOTICE SHOULD INCLUDE:
(a) IDENTIFICATION of the material that was disabled/removed and WHERE it appeared (short link/QR/bio/file URL) prior to removal.
(b) EXPLANATION OF RIGHTS OR DEFENCE, e.g., licence/permission, public domain, your authorship/ownership, or a lawful exception/limitation (quotation, parody, caricature, pastiche, incidental inclusion, etc.).
(c) GOOD‑FAITH STATEMENT. “I have a GOOD‑FAITH BELIEF that the material was removed or disabled as a result of MISTAKE OR MISIDENTIFICATION.”
(d) CONSENT TO DISCLOSURE. “I CONSENT to JN Short forwarding this counter‑notice and my contact details to the complainant.”
(e) CONTACT DETAILS for service of communications: full name, organisation (if any), postal address, country, email address, and phone number.
(f) JURISDICTION. If a dispute proceeds, you agree to accept service at the provided postal or email address and to cooperate in good faith with lawful proceedings in a competent court in your domicile or, where appropriate, Bulgaria.
(g) SIGNATURE. A physical or ELECTRONIC SIGNATURE (typed name is acceptable).
4.3 RESTORATION TIMING. UPON RECEIPT OF A VALID COUNTER‑NOTICE, we will INFORM THE COMPLAINANT. UNLESS WE RECEIVE EVIDENCE WITHIN TEN (10) BUSINESS DAYS THAT THE COMPLAINANT HAS COMMENCED COURT PROCEEDINGS OR OBTAINED AN ORDER, WE MAY RESTORE ACCESS to the material (for example, re‑enable the short link) where lawful and technically feasible. We are not a court and DO NOT ADJUDICATE COMPLEX OWNERSHIP DISPUTES; in such cases, we may maintain restrictions pending a competent authority’s decision.
IP 5. Repeat‑infringer policy
5.1 THRESHOLDS. An account may be designated a REPEAT INFRINGER where there are MULTIPLE SUBSTANTIATED IP VIOLATIONS (for example, THREE (3) OR MORE within a rolling 90‑DAY period) or any SINGLE EGREGIOUS BREACH.
5.2 CONSEQUENCES. Measures may include WARNING NOTICES, FEATURE RESTRICTIONS, PERMANENT TAKEDOWNS, GEO‑BLOCKING, API KEY REVOCATION, TEMPORARY SUSPENSION, or PERMANENT BAN, and related‑account blocking.
5.3 RECORDS. We may MAINTAIN INTERNAL RECORDS necessary to enforce this policy, consistent with our PRIVACY POLICY and data‑retention schedules.
IP 6. TRADE MARK / BRAND ABUSE (SEPARATE CHANNEL)
6.1 HOW TO REPORT. For TRADE MARK complaints (including counterfeit, source confusion, or misuse of protected marks), use https://jnshort.com/contact or e‑mail trademarks@jnshort.com.
6.2 REQUIRED ELEMENTS. Include: (a) the MARK at issue and, if registered, the REGISTRATION NUMBER(S) and JURISDICTION(S); (b) owner’s NAME and CONTACT DETAILS; (c) a representation of the mark (word/device); (d) the ALLEGEDLY INFRINGING USE (short link/QR/bio/file URLs) with screenshots; (e) the GOODS/SERVICES and classes; (f) the nature of confusion, passing‑off or dilution; (g) your AUTHORITY to act.
6.3 ACTIONS & COUNTER‑RESPONSE. We may take measures similar to copyright handling and notify the recipient with an opportunity to respond. Complex disputes may require a court or national IP office; WE DO NOT ADJUDICATE REGISTRABILITY OR OWNERSHIP.
IP 7. MISUSE OF THE IP NOTICE SYSTEM
Submitting FALSE, MISLEADING or ABUSIVE NOTICES or COUNTER‑NOTICES may result in ACCOUNT RESTRICTIONS and, where permitted by law, LIABILITY FOR DAMAGES. We may share aggregate statistics in our TRANSPARENCY REPORTS.
IP 8. INTERPLAY WITH DSA NOTICE‑AND‑ACTION & APPEALS
This IP Policy operates alongside our DSA procedures. WHERE WE RESTRICT CONTENT OR ACCOUNTS, WE PROVIDE A STATEMENT OF REASONS and an INTERNAL APPEAL path. Out‑of‑court dispute settlement under the DSA may be available for certain decisions; judicial redress remains available.
